Divorce Attorney Serving Marina Del Rey, Santa Monica, Westwood, West Los Angeles, and all of Los Angeles County
In California, divorce is one of three ways to end a marriage (the others are legal separation and annulment). Either spouse can choose to file a divorce, and the other spouse cannot prevent a divorce. While the spouse filing for the divorce doesn’t have to prove that the other spouse did anything wrong to receive a divorce, other issues related to the divorce may be hotly contested.
What Are the Legal Requirements for a Divorce?
Because California is a no-fault divorce state, all it takes to file for and receive a divorce is a statement by one or both spouses that the couple has “irreconcilable differences.” Because California recognizes same-sex marriages, divorces are available regardless of the genders of the spouses. Both California and out-of-state marriages may be dissolved through a divorce in California as long as the couple meets the residency requirements.
What Other Issues Are Decided in a Divorce?
Before a divorce is finalized, the court will enter orders regarding child custody, child and spousal support, and property division. If the spouses are able to agree on one or more issues, they may submit a settlement agreement to the court. Otherwise, they are entitled to a hearing to decide the contested issues.
