Child Centered Approach

In California, child custody is determined under a best interests of the child standard. The court has broad discretion to interpret this standard taking into account the relationship each parent had with the child before the divorce, each parent’s parenting skills, what will provide the child continuity and stability, any special health or safety concerns, and the child’s preferences if they are of sufficient maturity. This process may seem like it’s putting you on trial, but one of the most important things you can do is to show the court that you are 100% focused on your child’s well-being and not on becoming defensive or getting back at your spouse.

Custody Options

Custody decisions are divided into two categories. Legal custody covers the ability to make important decisions about health, religion, education, and other critical issues in the child’s life. Physical custody determines where the child will spend their time. California family judges are increasingly trending towards favoring both joint physical and joint legal custody. However, each parent has the opportunity to request that the court orders alternative arrangements if joint custody is not in the best interests of the child. Often, this will result in one parent being granted primary custody while the other receives visitation rights, but sole custody may be ordered if the circumstances warrant.
