In California, child custody is determined under a best interests of the child standard. The court has broad discretion to interpret this standard taking into account the relationship each parent had with the child before the divorce, each parent’s parenting skills, what will provide the child continuity and stability, any special health or safety concerns, and the child’s preferences if they are of sufficient maturity. Custody decisions are divided into two categories. Legal custody covers the ability to make important decisions about health, religion, education, and other critical issues in the child’s life. However, each parent has the opportunity to request that the court orders alternative arrangements if joint custody is not in the best interests of the child.
